Security of Payment for Sub-Contractors

Sub-contractors in the NSW building and construction industry can take action to secure progress payments for work they have performed or goods they have supplied.

The Building and Construction Industry Security of Payment Act allows for the adjudication of disputes over progress payments and provides for a fairer and quicker payment system for all parties.

From 28 February 2011, new laws allow sub-contractors who believe they are entitled to a progress payment to seek to ‘freeze’ payments to a contractor or other entity that engaged them. Click here to find out more about these new laws, or download a brochure that explains the process clearly.

How does the process work?

Sub-contractors lodge a progress payment claim with the contractor or entity that hired them for the job. If payment is not forthcoming, they apply to have the dispute adjudicated. Click here to learn how this process works.
